Default in payment of Non-Convertible Debentures (debentures) issued by D. S. Kulkarni Developers Ltd. (DSK)

DSK has defaulted in payment of dues to debenture holders since July, 2017. Catalyst Trusteeship Ltd. acting as Debenture Trustee (Trustee) for the said debentures, has filed an application with the National Company Law Tribunal, Mumbai Bench (NCLT) under section 71(10) of the Companies Act, 2013 and Debts Recovery Tribunal, Pune (DRT) under section 19 of the Recovery of Debts and Bankruptcy Act, 1993, in November, 2017 and January, 2018 respectively.

The DRT has passed final order dated 21st May, 2018 directing DSK to pay the dues to debenture holders within three months. In case, DSK fails to pay the dues to debenture holders within three months, the mortgaged properties will be put to sale as per DRT process for recovery of dues to debenture holders. The NCLT application is likely to be posted for hearing in due course of time as per its roster.

As of now, the debenture holders are not required to register any individual claims with the Trustee, since the order passed by the DRT includes the dues of all the existing debenture holders including interest.
